Contracts for ship-building and related contracts for supply of wood and other materials : from Corfu to Hydra (end of 15th century - mid 19th century)

Abstract:
In this study I examine contracts of ship-building and the associated contracts for supplying wood and other materials, necessary in ship-building and equipping a ship, on the basis of published and unpublished documents from Heptanesa, Hydra and other Aegean islands-nautical centres. These documents are dated in the period between the late 15th century, when the Turkish conquest of the Balkan inland and islands has been completed and the Venetian domination of Heptanesa has been consolitaded, and the mid 19th century.Ship-building contracts are a classic case of hiring services (loca- tio operis faciendi) -only rarely Γ 11 consider them as sale- while the contract for provisioning wood and other materials can be considered invariably as sale, hire of services and rarely as hiring labour. In the next section I examine in some detail the particular elements of these contracts, such as the duties of the contractor and employer, the dissolution of the contractual relationship and the clauses safeguarding the performance of the contract. In the final section I explore the origins of the legal rules applied. The law did not change over time in both the Venetian and the Ottoman dominated areas.
